Agency Recruitment Agreement

This Agency Recruitment Agreement ("Agreement") is between {Company Name} LLC ("we", "us") and the law enforcement agency that creates an agency account, publishes a recruitment profile, or buys a profile plan on SecondWatch Careers ("Agency", "you"). It adds to the Terms of Service and the Acceptable Use & Posting Guidelines, which are part of this Agreement. If your agency also buys job posts, the Employer Agreement applies to those posts.

Version 2026-10-05.draft7 · Effective {Effective date}

1. Authority

The person accepting this Agreement confirms that they're employed by, or formally authorized to act for, the Agency, and have authority to publish recruitment information for it and to bind it. {Attorney: public entities may be unable to accept indemnity, limitation-of-liability, governing-law or arbitration clauses, or click-through terms at all. Consider a public-agency addendum.}

2. Verification

Before a profile is published (and again if key details, such as the agency name, change), we verify the account, for example by a one-time code sent to an official agency email domain, or by reviewing a document such as an authorization letter on agency letterhead or an ID badge photo, possibly with a verification call. You'll provide truthful verification information and won't submit anyone else's documents without authorization. Verification documents are used only for verification and are deleted on the schedule in our Privacy Policy. A "Verified agency" badge shows only that we completed these steps. It isn't an endorsement.

3. Accuracy of the profile

Profile content (pay, step placement, lateral-entry rules, academy waivers, pension, take-home car, schedules, hiring process, FAQ, photos) is shown publicly as provided by your agency with a "Last updated by agency" date. Your hiring timeline (steps, typical durations, acceptance of out-of-state certifications, lateral academy or waiver and lateral pay-step policy) is shown as "Agency-provided" on your profile and on your job posts, next to officer-reported hiring times that we moderate and show only as aggregates. You'll keep it accurate and current, correct errors promptly, and not publish anything misleading about pay, benefits or hiring standards. Figures that vary (e.g. bonuses) should state their conditions.

4. Recruiter contact consent

Recruiter contact details (name, work email, phone) are published only if you tick the consent box on the profile form. By ticking it, you confirm that the named recruiter has agreed to have those work contact details shown publicly and contacted by prospective applicants. You can untick it at any time to hide them immediately. Don't enter personal (non-work) contact details, and never enter an officer's home address or family information.

5. EEO and lawful requirements

You confirm that your agency is an equal opportunity employer and that your profile doesn't express a preference or limitation based on a protected characteristic, except for requirements set by law for the position (for example a statutory minimum age, a maximum entry age where permitted, citizenship, or POST/peace-officer standards on criminal history), which you'll identify on request. Our automated wording check may hold a profile for human review. It never rejects anything by itself, and our review isn't legal advice.

6. Pay information

Where you publish starting or top-out pay, it must be accurate. If the law of your jurisdiction requires pay ranges in job advertisements, your job posts must include them (see the Employer Agreement).

7. Fees, plans and refunds

Profile plans and prices are shown at checkout, in U.S. dollars. Payment is processed by Stripe. One-time profile plans run for the period shown and don't renew automatically. Refunds: {Refund policy: e.g. full refund if we reject a post before it goes live; otherwise no refunds}.

Agency subscription plans (DRAFT, added 2026-10-05). When subscriptions are switched on, entry-level recruit postings are free, and Agency Basic and Agency Plus are monthly or annual plans that include lateral/specialty postings, your recruitment profile and other features shown on the Pricing page. These plans renew automatically until cancelled from your billing page; cancellation takes effect at the end of the paid period. A posting published free as entry-level can't later be changed into a lateral or specialty posting. Featured in-state placement on Agency Plus is always labeled and never overrides an officer's filters. {Attorney: automatic-renewal and public-procurement rules for government agencies (many agencies can't accept auto-renewing card subscriptions or need invoices/POs); see note 107.}

Annual plans paid by invoice or purchase order (DRAFT, added 2026-10-05). An agency may choose to pay an annual plan by invoice instead of by card. You may give a purchase-order number, which we show on the invoice. The plan starts when the invoice is issued. The invoice is due net 30 (30 days after issue). If it is unpaid on the due date, plan features continue for the grace period shown on your billing page and then pause until payment is received. Invoice-billed plans do not renew automatically; we issue a new invoice for each following year only if you ask for one. You may cancel before payment by asking us to void the invoice, and your plan ends when the invoice is voided. Our vendor details for your accounts-payable setup (legal name, address, taxpayer identification and remittance instructions) are provided on request {Sam: supply business details and a signed W-9; Attorney: see note 109 on procurement terms, net-30, late payment, and whether a government purchase order's own terms override these}.

7A. Applications from officers

Only verified law enforcement officers can apply to your job posts, using the on-site Apply form. For each application you receive the details the officer chose to share: their name (full name, display name or initials, as they chose), resume, cover note and verified-officer status, plus their email, phone, agency, city/state, qualifications and military service only if they ticked them. Contact applicants through the Site's messages unless they shared another way to reach them. If an applicant shared qualifications, the Site may show you a match label computed only from what they shared. It's an automated sorting aid, not a recommendation, and you must not use it as the sole basis for any hiring decision. You agree to:

  • use applicant information only to consider that officer for the job they applied to, and handle it confidentially and securely, under applicable privacy, anti-discrimination and record-keeping laws;
  • not sell, share, publish or add it to a database for other purposes, and not contact officers who didn't apply to you through information obtained from the Site;
  • not rely on "verified officer" as a background check (it isn't one) and follow the Fair Credit Reporting Act and state law if you run background checks;
  • delete downloaded applicant data when you no longer need it for that hiring decision, subject to your legal record-keeping duties {Attorney: confirm wording}.

We log each time applications are viewed or resumes downloaded. Applications are deleted from the Site on the schedule in the Privacy Policy or when the officer withdraws.

Recruiter contact details and your application link are shown only to verified officers when the Site's gating setting is on.

7B. Team accounts, officer search, upgrades and company pages

The Employer Agreement's section 6B (team accounts, officer search, analytics and company pages) and its terms for upgrades (section 2) also apply to your agency account. In particular: officer search is available only while your agency is verified; you must not try to identify an officer from an anonymous card (officers' own agency is blocked from seeing their card automatically) or contact officers outside the Site based on a card; and your company page shows the review summary and your published responses from your agency record, which you can't remove from it.

8. Content license

You grant us the same license to your profile content, logo and photos as in section 7 of the Employer Agreement, including to show your profile in agency comparisons with other agencies. You confirm you have rights to all photos and logos you upload (including any officers pictured having agreed to appear).

9. Review, removal and suspension

We may review, hold, decline, remove or stop displaying a profile, or suspend the account, if we believe it violates this Agreement, the Terms, the Guidelines or the law, following a report, or if verification lapses.

Agency records and reviews. Your agency may already have a record in our agency directory ("Unclaimed profile"), created from real job listings, with officer reviews and reports. You may claim it only for your own agency, through verification. Officer reviews, pay reports and hiring-time reports are about your agency, not content of your account: they stay on your agency's record if you delete your account, and you can't remove them except by reporting a review that breaks our rules. Your responses to reviews are deleted with your account.

10. Responsibility for hiring; indemnity; liability

You're solely responsible for your recruitment and hiring process and decisions and for complying with applicable law. To the extent permitted by law for a public entity, you'll indemnify us as described in the Employer Agreement. {Attorney: public-entity limits.} The disclaimers and limits of liability in the Terms apply.

11. Public records

We understand agency communications may be subject to public-records laws. Nothing in this Agreement requires you to keep confidential anything the law requires you to disclose.

12. Changes and general

We may update this Agreement. For material changes we'll update the version, and you'll be asked to accept the new version at your next login and before your next purchase. Governing law and disputes follow the Terms ({Governing law state}), unless a public-agency addendum says otherwise.
